There are four streams within work visa instructions:

  • The skilled stream;
  • The family stream;
  • The international/humanitarian stream; and
  • The special work stream.

A) SKILLED STREAM

The Skilled stream consists of four type of work visas:

  • Work to residence;
  • Essential skills; and
  • Specific purpose or event; and
  • Students/trainees.

Work to Residence visa facilitates the entry of people whose skills are in demand and provides them with a pathway to residence. Essential skills visa facilitates the entry of people required on a temporary basis to fill shortages where New Zealand citizens or residence class visa holders are not available for the work offered. Specific purpose or event visa facilitates the entry of people who have demonstrated skills, expertise or attributes that are likely to benefit New Zealand, where there is no risk of negative impact on opportunities for New Zealand citizens or residence class visa holders. Students and trainees facilitates the entry of students and trainees to gain practical work experience or to train as part of their studies.

B) FAMILY STREAM

The Family stream enables the following people to undertake temporary employment in New Zealand:

  • the partners of New Zealand citizens or residence class visa holders, and partners of Long Term Business Visa holders, whose ultimate intention is likely to be to apply for residence; and
  • the partners of holders of work visas.

C) INTERNATIONAL/HUMANITARIAN STREAM

The International and Humanitarian stream consists of:

  • working holiday schemes to allow people from other countries to be granted permission to work on a reciprocal basis; and
  • provisions to enable New Zealand to meet its humanitarian and international obligations.

D) SPECIAL WORK POLICIES STREAM

The special work stream consists of:

  • horticulture and viticulture seasonal work instructions;
  • foreign crew of fishing vessels instructions;
  • religious worker instructions.

The horticulture and viticulture seasonal work visas facilitate the entry of seasonal workers to support the horticulture and viticulture industries. The foreign crew of fishing vessels instructions provide for the grant of work visas to foreign crew employed on fishing vessels in New Zealand’s fisheries waters. The religious worker instructions enable the entry of workers to undertake genuine religious work in New Zealand, providing New Zealand communities with the opportunity to practice, maintain and advance their religious beliefs.

Applicants for all visas must be of good character, not pose a security risk and not threaten New Zealand’s international reputation. People with serious character issues can’t be granted any visa or entry permission, except in very special circumstances. Those with other character issues must have the good character requirement waived before they can be granted a temporary visa.

GENUINE INTENTIONS

You must genuinely intend to meet the conditions of your visa. The primary lawful purpose of a student visa is to undertake study.

When you apply for a temporary visa or permission to enter New Zealand, the Immigration New Zealand must be satisfied that you have genuine reasons for coming to New Zealand on the visa you apply for, and that while you are there you will obey the law.

They must believe that you:

  • only intend to stay in New Zealand temporarily
  • are coming to New Zealand for a lawful purpose
  • will comply with the conditions of your visa after you arrive
  • will not stay in New Zealand without a valid visa, and
  • are able to leave New Zealand at the end of your stay.

They will consider:

  • the information you provide on your visa application or your arrival card
  • the documents you provide to support your visa application
  • any information they have about your personal circumstances
  • any information they have about your previous applications.

You must provide documents that show you meet all the criteria for the visa you are applying for, and support your reasons for spending time in New Zealand. When the Immigration New Zealand assesses information about your personal circumstances, they look at things like any family ties you may have in your home country or in New Zealand; any personal, financial, work or other commitments you may have in your home country or New Zealand; any circumstances that mean you may not want to return to your home country.

Information from your previous applications and travel to New Zealand can tell the Immigration New Zealand if you have stayed in New Zealand after your previous visa expired, if you breached your visa conditions or if you have a family member who is in New Zealand without a visa.

You must also answer truthfully when you complete your visa application or arrival card. If the Immigration New Zealand believes you provided any false or misleading information, you may not be able to get a visa or allowed to enter New Zealand.
